Amendments to the Federal Aviation Rules "General rules for the air transportation of passengers, baggage, cargo and requirements for servicing passengers, consignors, consignees", approved by order of the Ministry of Transport of the Russian Federation dated June 28, 2007 No. 82, in terms of baggage

1. Subparagraphs 10 and 12 of paragraph 25 shall be stated as follows:

"10) the passenger's baggage at the conclusion of the contract air transportation a passenger who provides for the norm free transportation baggage in excess of the free baggage allowance established by the carrier or the baggage of a passenger when he concludes an air carriage agreement for a passenger that does not provide for a free baggage allowance (hereinafter referred to as excess baggage);

12) passenger baggage, the weight of one piece of which exceeds thirty kilograms (hereinafter referred to as heavy baggage).

2. The third paragraph of clause 37 shall be amended as follows: "on the terms of the passenger air carriage agreement, including the free baggage allowance in the event that the passenger concludes the passenger air carriage agreement providing for the free baggage allowance, the carry-on baggage allowance, including the carriage of things specified in paragraph 135 of these Rules, items and things prohibited for transportation, conditions for the carriage of baggage, conditions for the carriage of goods purchased in the sterile area of ​​the airport.".

3. Paragraph 85 shall be stated as follows:

"85. When checking in and / or checking in baggage, the passenger is obliged to present for weighing all baggage intended for carriage as checked baggage.

When checking in and/or boarding, the passenger, at the request of the carrier, must present for weighing hand luggage specified in paragraph 133 of these Rules, as well as a backpack, baby cradle, baby carriage when transporting a child, specified in paragraph 135 of these Rules.

4. In paragraph 87:

a) the first paragraph shall be stated in the following wording:

"87. When checking in baggage, a passenger is given a part (tear-off coupon) of a numbered baggage tag, and the other part is attached to each piece of baggage accepted by the carrier for transportation in the baggage compartment of the aircraft under the responsibility of the carrier for the safety of such items from the moment they are handed over by the passenger until the moment they are handed over to the passenger (hereinafter referred to as checked baggage)";

b) the fourth paragraph is recognized as invalid.

5. In the third paragraph of clause 113 the words "free baggage allowance" shall be replaced by the words "free carry-on baggage allowance".

6. The title of Chapter X shall be stated as follows:

"Transportation of luggage and hand luggage".

7. Paragraph 122 shall be stated as follows:

"122. When concluding an air carriage agreement for a passenger that provides for a free baggage allowance, the passenger of an aircraft has the right to carry his baggage within the limits established by the carrier at no additional charge (hereinafter referred to as the free baggage allowance).

The free baggage allowance is set by the carrier and provides for the number of pieces and weight of baggage per passenger of the aircraft. At the same time, the free baggage allowance established by the carrier cannot provide for less than ten kilograms per passenger of the aircraft.".

8. Paragraph 123 shall be stated as follows:

"123. When a passenger concludes an air carriage agreement for a passenger that provides for a free baggage allowance, the carrier is obliged to accept baggage for carriage within the free baggage allowance.

In the event that a passenger concludes an agreement for the air carriage of a passenger that does not provide for a free baggage allowance, the carrier is obliged to accept for carriage the baggage paid for by the passenger at the baggage rate established by the carrier.

9. Paragraph 125 shall be stated as follows:

"125. If a passenger has presented baggage for carriage with a weight and/or size and/or number of pieces less than he booked and paid in advance, the difference in payment for the carriage between the paid and actual weight and/or size and/or number of pieces baggage must be returned to the passenger.

10. Paragraph 127 shall be stated as follows:

"127. At the request of passengers traveling together with the same purpose of travel to the same airport (point) of destination or airport (point) of stopover on the same flight (family members, persons traveling together or on a business trip), and when when such passengers enter into passenger air carriage agreements that provide for a free baggage allowance, the carrier is obliged to combine the amount of free baggage allowance by weight of each passenger.

In the event that the passengers referred to in this clause enter into passenger air carriage agreements that do not provide for a free baggage allowance, and provided that such passengers pay for the baggage at the baggage rate established by the carrier, the carrier is obliged, at the request of the passengers, to combine the weight of the baggage provided for by the baggage rate.

The weight of one piece of combined baggage must not exceed thirty kilograms and is accepted for carriage without charging an additional fee.

If the weight of one piece of combined baggage exceeds thirty kilograms, payment for such baggage is carried out in accordance with paragraph 136 of these Rules.

Baggage is subject to check-in for each passenger individually.

11. Paragraph 133 shall be stated as follows:

"133. An aircraft passenger has the right to carry hand luggage in the cabin of the aircraft within the limits established by the carrier at no additional charge (hereinafter referred to as the free carry-on baggage allowance).

As carry-on baggage, things are accepted that do not contain substances and items prohibited for transportation in the aircraft cabin, the weight and dimensions of which are established by the carrier and allow them to be safely placed in the aircraft cabin.

The free carry-on baggage allowance established by the carrier cannot be less than five kilograms per passenger.

Hand luggage exceeding the weight and/or dimensions established by the carrier" free hand luggage allowance is checked in by the passenger as baggage in accordance with the terms of the concluded air carriage agreement

12. Paragraph 135 shall be stated as follows:

"135. As hand luggage in excess of the allowance established by the carrier in accordance with paragraph 133 of these Rules, and without charging an additional fee, the passenger has the right to carry the following items:

a backpack, the weight and dimensions of which are established by the rules of the carrier, or a handbag, or a briefcase with things enclosed in a backpack, or bag, or briefcase;

bouquet of flowers;

outerwear;

baby food for the child during the flight;

suit in a suitcase;

a device for carrying a child (a cradle, restraint systems (devices) for children under two years of age, a baby stroller and other devices) when transporting a child, the dimensions of which are established by the carrier’s rules and allow them to be safely placed in the aircraft cabin on a shelf above the passenger seat, or the floor of the seat in front of the standing passenger seat;

medicines, special dietary needs in the amount required for the duration of the flight;

crutches, canes, walkers, rollators, a folding wheelchair used by a passenger and having dimensions that allow them to be safely placed in the aircraft cabin on a shelf above the passenger seat or under the seat in front of the passenger seat;

goods purchased in duty-free shops at the airport, packed in a sealed (sealed) plastic bag, the weight and dimensions of which are established by the rules of the carrier.

13. Paragraph 136 shall be stated as follows:

"136. Transportation oversized baggage, heavy baggage, service dogs, pets and birds is paid based on its (their) actual weight, dimensions and number of pieces at the baggage rates established by the carrier, regardless of other things of the passenger carried as checked baggage, with the exception of a guide dog traveling with a visually impaired passenger, a wheelchair, crutches, canes, walkers, rollators used by a disabled passenger and other persons with disabilities, as well as a baby carriage used by a passenger, having dimensions that do not allow it (them) to be safely placed in the cabin of the aircraft on a shelf above the passenger seat or under the seat in front of the passenger seat, and transported at no additional charge.

When carrying excess baggage, if a passenger concludes an air carriage agreement for a passenger that provides for a free baggage allowance, the difference between the established free baggage allowance and the weight of the pieces of baggage presented for transportation is paid at the baggage rates established by the carrier.

When transporting excess baggage, if a passenger concludes an air carriage agreement for a passenger that does not provide for a free baggage allowance, the transportation of such baggage is paid at the baggage rates established by the carrier.

14. Subparagraph 4 of paragraph 230 shall be stated as follows:

"4) the refusal of the passenger of the aircraft to pay for the carriage of his baggage in the amount and on the terms that are provided for by the contract for the air carriage of the passenger."

Amendments to come into force in September Air Code, which will give airlines the right to charge money for the baggage transportation service as part of non-refundable fares. But on a ticket that can be returned, the free baggage allowance will remain 10 kilograms.

Passengers will have to carefully look at the conditions under which they conclude a contract of carriage with the airline, that is, they buy a ticket, after the amendments to the Air Code come into force.

It is possible that it will be possible to transport baggage weighing more than 10 kilograms from major carriers on a number of tickets. Especially those who are members of international aviation alliances. The airlines set the limit there. different countries by agreeing among themselves.

In addition, passengers traveling as a family have the right to combine their luggage limit. For example, a family of three will be able to take one suitcase for three, but weighing 30 kilograms.

But for a larger weight of the suitcase, you will have to pay as for oversized cargo, the Ministry of Transport specified. As for airlines that carry passengers on non-refundable tickets, you will have to pay for any baggage.

And if the passenger decides to take it after buying a baggage-free ticket, then it is worth paying for the baggage transportation service through the carrier's website. This can cost half as much as paying for it just before the flight when checking in for a flight.

Passengers who bought tickets before the entry into force of the new requirements of the Air Code (that is, before September 29, 2017), even at the end of this year, have the right to take baggage according to the old rules, because they have already entered into a contract of carriage, experts remind.

Those who buy tickets before September 29 will be able to take luggage with them on the flight according to the old rules.

The Ministry of Transport has not yet approved the new rules for carrying hand luggage.

According to forecasts of the ministry, the cost of tickets without luggage will be 15-20 percent cheaper than the price of a flight with a suitcase. And they will be in demand by at least a quarter of passengers who fly short distances. That is how many people flew without baggage even before the introduction of the new norm of the Air Code. Now, perhaps, there will be more such passengers.

But we must take into account if the passenger decided to buy additional service for the transportation of a suitcase, then in case of a non-departure, according to the new requirements of the Air Code, the money for baggage services must be returned to him.

And you can get money for the air ticket itself if the trip was canceled due to the illness of the passenger. And in his hands he has a sick leave or an extract from a medical institution, writes Rossiyskaya Gazeta.

Changes in the Air Code of Russia come down to granting airlines the right to take money for any movement of a passenger

Carrying luggage on airplanes, until recently simple and understandable, suddenly began to raise a lot of questions. This is due to the extraordinary activity of the Ministry of Transport and Aeroflot, pushing through strange laws one after another, supposedly making life easier for business.

But making it unbearable for ordinary people.

Spies and saboteurs are perhaps the only ones who fly without any luggage and buy everything they need upon arrival. From shorts to toothpicks. However, a respectable person, even for a week, needs at least 2-3 kilograms of personal belongings and 2-4 kilograms of equipment (laptops are now, of course, light, but by no means weightless - not to mention cameras).

How do laws change?

Until 2013, the baggage rules for air travel were well known and mandatory for everyone, regardless of the company and flight: up to 10 kg of luggage for free, hand luggage in the cabin - no more than a certain size, but turned a blind eye to a slight excess. Each person, having gathered at the airport, knew exactly whether his luggage complied with the norms. With the widespread use of the Internet, all airlines have also introduced the possibility of free check-in for a flight with seat selection 24 hours before departure.

But now, on the wreckage of the Dobrolyot low-cost airline that collapsed under the sanctions, a new, national low-cost airline, Pobeda, has appeared in Russia. And his managers read the Air Code very carefully and found that nothing was said about hand luggage and free Internet check-in. As a result, Pobeda allowed to carry in the cabin only those things that were clearly prescribed in the law as mandatory and free (suits in suitcases, umbrellas, cameras, laptops, handbags ...). For the rest, including purchases from airport stores (the so-called duty free), which in principle have nowhere to go, except for the salon, a tangible amount was charged, sometimes exceeding the cost of the ticket.

The degree of hatred for Pobeda rose to the limit when the company was convicted of deliberately seating families, including those with children, in different corners of the cabin during check-in at the airport. Meanwhile, this company controlled by Aeroflot did not violate any laws: it simply took advantage of gaps in the legislation.

And now, finally, we have before us the reaction of Parliament. It seemed natural to close the gaps and return everything to normal. However, the Ministry of Transport and Parliament did exactly the opposite.

Irrevocable and baggage free

According to the law adopted at the end of July 2017, the obligation of the carrier to provide the passenger who bought non-refundable ticket, free baggage allowance of 10 kg. This preference is considered non-market: now airlines will be able to compete for passengers, providing them with the “best” prices for baggage transportation. The authors of the bill (Ministry of Transport, behind which the ears of Aeroflot stick out) assure that now the prices for flights will definitely decrease. Maybe. The ticket price will drop, but this will be more than offset by the cost of carrying luggage.

This law will take effect 60 days after its official publication, approximately in late September - early October. The time is well chosen: the tourist season is already over, so no special complications are expected. The law emphasizes that the carrier is obliged to explicitly notify the passenger of the cost of baggage transportation already at the time of ticket purchase.

For holders of return tickets, the rules remain the same. Another question is that such tickets cost twice as much, but do not provide any advantages during the flight: for example, you have to sit in the same tightness between the “non-returners”.

Encouraged by the success, the Ministry of Transport decided to immediately strike the next blow by preparing new rules for carrying hand luggage. If earlier its weight was not prescribed in the law, now the department decided to describe the weighing procedure. Among other things, a list of items has been developed that can be carried in excess of the new weight of hand luggage (5 kg) without weighing. And here the scandal erupted.

Speaker of the Upper House of Parliament Valentina Matvienko, who without a shadow of a doubt signed any laws (including supporting the abolition of free baggage allowance), suddenly decided to protect the people and spoke about the provocative nature of the document:

“As for hand luggage, you wrote some nonsense there that you can’t bring flowers, phones, outerwear. Who is the author of this document? This is collective irresponsibility! The ministry should take into account the remarks of the senators and prevent similar mistakes in the future. If we are not satisfied, we will do our best to draw appropriate conclusions. Up to the fact that the head of the Ministry of Transport is punished administratively!”

Meanwhile, of course, there are no prohibitions on flowers and phones in the document. It’s just that they are not included in the list of items that can be carried “in excess of the weight limit established by airlines for hand luggage” (previously there was no such concept at all). Crutches - you can, a suit - you can, a handbag of any weight - you can. The rest will have to be weighed and fit into 5 kg (or another norm of a particular airline, but not less than 5 kg). Although, of course, no one will reach into your pocket for the phone. The oddities of legislators are sometimes nevertheless compensated by the common sense of business.

However, say, a fur coat or a large laptop will most likely have to be checked in as luggage. Given the refined manners of airport porters, it's easy to guess what will happen to these items after two or three flights.

We emphasize that this scandalous initiative has not only not been adopted, but has not even become a bill yet: it is just a “document in the first approximation,” as a representative of the Ministry of Transport, frightened by the attack by Valentina Matviyenko, whispered.

In fact, clear and uniform rules for carrying hand luggage are needed, and the ministry is doing the right thing. That's just 5 kg, excluding fragile equipment - it's still a mockery. There is no doubt that in the process of preparing new amendments to the Air Code, this error will be corrected.

We also emphasize that airlines are not required to take money for luggage and hand luggage: they only get such a right.
